4. Information Platform Disclaimer

IMPORTANT: eAuctions India is purely an information aggregation and display platform. We:

• Do NOT conduct auctions or sell properties/vehicles
• Do NOT act as an intermediary, agent, or broker for any bank or financial institution
• Do NOT participate in the auction process in any capacity
• Do NOT handle any financial transactions related to auctions
• Do NOT verify the authenticity, accuracy, or current status of listings beyond sourcing from official sources
• Are NOT responsible for the auction process, bidding, or final sale

All auction-related transactions, inquiries, and bidding must be conducted directly with the respective banks or authorized auction service providers listed in each auction notice.

5. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for:

• Maintaining the confidentiality of your account password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

6. Intellectual Property Rights

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by eAuctions India, its licensors, or other providers of such material and are protected by Indian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

• Damages resulting from your access to or inability to access the Services
• Damages resulting from any auction transaction or relationship with banks
• Damages resulting from unauthorized access to or alteration of your transmissions or data

12. Indemnification

13. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in India.

15. Dispute Resolution

If the dispute cannot be resolved within 30 days, either party may pursue resolution through binding arbitration in accordance with the Indian Arbitration and Conciliation Act, 1996.

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and eAuctions India regarding the use of the Services and supersede all prior and contemporaneous written or oral agreements.
